On May 21, 2024, the Arizona State Legislature adopted House Bill 2720, which requires municipalities with populations of 75,000 or more to adopt regulations permitting accessory dwelling units (ADUs) on all lots where single-family dwellings are allowed by January 1, 2025.

Tempe City Council has adopted an amended ADU ordinance based on the mandate and public feedback. View the adopted ordinance here.

 *Update* On June 6, 2025, a Zoning Administrator's Opinion was issued to clarify that the allowed height of an ADU, whether attached or detached, is regulated based on the zoning district standards for height in order to conform with ARS 9-461.18.

*Update* On October 3, 2025, a Special Zoning Administrator's Opinion was issued to clarify that the Use Permit requirement for any two-story ADU conflicts with the legislative intent of A.R.S. 9-461.18.

*Update* On December 17, 2025, the Board of Adjustment approved an appeal of the Special Zoning Administrator's Opinion, effectively requiring a Use Permit for any two-story accessory dwelling units. The Special Zoning Administrator's Opinion is no longer in effect unless the Board of Adjustment's decision is appealed to the Superior Court within 30 calendar days and subsequently overturned.
